Terms and Conditions for Users

Article 1 - Definitions

1.1. Four planning
The provider of the online software solution 4planning, which enables organisations to manage members, users, groups, events, communication, documents, contributions, tickets, scheduling and other organisational processes, among other things.

1.2. Organisation
The association, foundation, sports club, business club, company, institution or other organisation that uses 4planning and grants you access to the app.

1.3. User
Any natural person who has access to 4planning through an organisation, such as a member, employee, volunteer, administrator, group administrator, client, participant or other stakeholder.

1.4. Account
The personal user account with which you access the organisation's app.

1.5. App
The digital 4planning app or web application in which you can make use of functionalities such as communication, events, documents, planning, news, polls, registrations, member information and other available components.

1.6. Content
All information that you post, upload, transmit or share via 4planning, including messages, comments, documents, images, profile data, registrations and other data.

Article 2 – Applicability

2.1. These terms and conditions apply to all use of 4planning by users.

2.2. By using 4planning, you declare that you have read and accept these terms and conditions.

2.3. If you are using 4planning on behalf of an organisation or in an administrative role, additional terms and conditions may apply.

2.4. The organisation may have its own rules, house rules or agreements for the use of its app. You must also comply with these rules.

Artikel 3 – Toegang tot de app

3.1. You will be granted access to 4planning via an organisation that uses 4planning's services.

3.2. The organisation determines whether you get access, which data is visible to you, and which functions you may use.

4planning is not responsible for the way in which the organisation invites, manages, groups or assigns rights to users.

3.4. 4planning may temporarily restrict or block your access if this is necessary for the safety, continuity or integrity of the services.

Article 4 – Account and login details

Your account is personal and may not be shared with others.

4.2. You are responsible for keeping your login details confidential.

4.3. You must use a strong password and handle access to your account with care.

4.4. If you suspect that someone else has gained access to your account, you must report this to the organisation or to 4planning as soon as possible.

4.5. You are responsible for all activities that take place via your account, unless you can demonstrate that misuse occurred through no fault of your own.

Article 5 – Use of 4planning

5.1. You may only use 4planning for normal communication, planning, participation, administration, and collaboration within the organisation that has granted you access.

5.2. You may not use 4planning for unlawful, misleading, harmful, commercial, or unwanted purposes.

5.3. It is not permitted to distribute spam, unsolicited advertisements, offensive messages, discriminatory content, threats, harmful files, or other inappropriate content via 4planning.

5.4. You may not perform any actions that could harm the operation, safety, availability, or reputation of 4planning.

5.5. You must not attempt to access data, accounts, groups, documents, or functions for which you do not have authorisation.

Article 6 – In-app communication

4planning may include features for news feeds, group messages, private messages, polls, events, notifications, emails, push notifications, and other forms of communication.

6.2. You must communicate with other users respectfully, carefully, and appropriately.

6.3. The organisation may manage, moderate, remove, or restrict communication within its app.

4planning is not responsible for any messages, communications, or content posted by the organisation or other users.

Article 7 – Events, registrations and participation

7.1. The organisation can publish events, activities, meetings, training sessions, services or other gatherings via 4planning.

7.2. You are solely responsible for correctly and timely registering, deregistering or changing your participation, insofar as the app offers these functionalities.

7.3. The organisation is responsible for the content, planning, execution, terms and conditions, and any changes to events.

7.4. 4planning is not responsible for the continuation, cancellation, modification, or execution of events organised by the organisation.

Article 8 – Documents and files

8.1. Via 4planning, documents, images, files and other information can be made available.

8.2. You may only use documents and files for the purpose for which they have been made available within the organisation.

8.3. It is not permitted to copy, distribute, publish or share confidential documents or information with third parties without permission.

8.4. If you upload or share files yourself, you are responsible for their content and guarantee that you are authorised to use and share these files.

Article 9 – Profile Data and Visibility

9.1. You can complete, modify or make certain profile details visible within 4planning, depending on the organisation's settings.

9.2. You are responsible for the accuracy and up-to-dateness of the data you enter yourself.

9.3. The organisation may require certain data for administration, planning, subscriptions, communication or participation in activities.

9.4. Depending on the settings, certain data may be visible to administrators, group administrators, or other users.

Article 10 – Privacy and personal data

10.1. When using 4planning, personal data may be processed.

10.2. The organisation is principally responsible for the personal data it processes via 4planning.

10.3. 4planning processes personal data on behalf of the organisation, insofar as this is necessary for the provision of the services.

10.4. For more information on the processing of personal data, please refer to 4planning's privacy statement and, if applicable, to the organisation's privacy information.

10.5. For questions about your data, rights, or the processing of personal data, you should initially contact the organisation that gave you access to the app.

Article 11 – User Content

11.1. You remain responsible for all content that you post, upload, transmit or share via 4planning.

11.2. You guarantee that your content does not infringe the rights of third parties and does not violate any laws, regulations, or these terms and conditions.

11.3. 4planning and the organisation reserve the right to remove or disable content if it breaches these terms, the organisation’s rules, or applicable legislation.

11.4. 4planning is niet verplicht om content van gebruikers actief te controleren.

Article 12 – Availability and operation

12.1. 4planning will make every effort to ensure the app is available carefully and to the best of its ability.

12.2. 4planning does not guarantee that the app will always be available without interruption, error or failure.

4planning may carry out maintenance, updates, improvements or changes to the app.

12.4. Certain functions may temporarily be unavailable due to maintenance, malfunctions, technical limitations or changes.

Article 13 – Intellectual property

13.1. All rights to 4planning, including the software, design, technical solutions, texts, logos, documentation, and other materials, remain the property of 4planning or its licensors.

13.2. You are granted solely a personal, limited, and non-transferable right to use 4planning for as long as you have access through the organisation.

13.3. It is not permitted to copy, modify, distribute, sell, rent, reverse-engineer or otherwise use parts of 4planning outside of the normal use of the app.

Article 14 – Termination or Blocking of Access

14.1. The organisation may terminate or restrict your access to 4planning, for example, when you are no longer part of the organisation or when your role changes.

14.2 4planning may restrict, suspend or block your access if you breach these terms, or if it is necessary for safety, continuity or the protection of other users.

14.3. After your access ends, you may no longer be able to use data, messages, documents or other components within the app.

14.4. Data that are part of the organisation's administration may be retained after your access has ended for as long as this is necessary or legally permitted.

Article 15 – Liability

15.1. 4planning is niet aansprakelijk voor schade die ontstaat door het gebruik van de app, behoudens opzet of bewuste roekeloosheid van 4planning en behoudens schade door dood of letsel. Deze uitsluiting laat de wettelijke rechten van een consument onverlet.

4planning is not responsible for any decisions, communications, events, documents, data, payments, or other actions of the organisation.

15.3. 4planning is not liable for indirect damage, consequential damage, loss of data, damage to reputation, missed savings, or damage caused by the actions of other users.

15.4. Voor zover 4planning toch aansprakelijk is, is deze aansprakelijkheid per gebeurtenis beperkt tot € 500, en tot € 1.000 voor alle gebeurtenissen samen in een kalenderjaar. Deze beperking geldt niet bij opzet, bewuste roekeloosheid of schade door dood of letsel.

Article 16 – Indemnity

16.1. You shall indemnify 4planning against third-party claims arising from your use of 4planning, your content, or your breach of these terms.

16.2. This disclaimer shall not apply if the claim results from the wilful intent or conscious recklessness of 4planning.

Article 17 – Amendment of these terms

17.1. 4planning may amend these general terms and conditions.

17.2. Een wezenlijke wijziging maken wij ten minste 30 dagen vóór de ingangsdatum bekend via de app en, waar wij een adres van u hebben, per e-mail. Kleine tekstuele correcties kondigen wij niet apart aan.

17.3. By continuing to use the door4planning after the change, you accept the modified terms.

17.4. Bent u het niet eens met een wezenlijke wijziging, dan kunt u uw gebruik van 4planning beëindigen vóór de ingangsdatum; tot dat moment blijven de oude voorwaarden voor u gelden. Laat het ons weten via support@4planning.nl.

Article 18 – Applicable Law and Disputes

18.1. Dutch law applies to these terms and the use of 4planning.

18.2. Disputes shall be submitted to the competent court in the Netherlands, unless mandatory law dictates otherwise.

18.3. The parties shall endeavour to resolve disputes by mutual consultation first.

Article 19 - Final Provisions

19.1. If one or more provisions of these terms and conditions are found to be invalid, the remaining provisions shall remain in full force and effect.

19.2. In situations not covered by these terms and conditions, 4planning shall act with reasonableness, fairness, and customary practices.
