Article 1 - Definitions
1.1. General terms and conditions of ticket
These terms and conditions apply to the purchase, reservation, acquisition, and use of tickets via 4planning.
1.2. 4planning
4planning, an online software solution provider, enables organisations to manage events, ticket sales, access control, communication, and other organisational processes, among other things.
1.3. Services
All services that 4planning makes available to the ticket buyer via the platform in connection with the purchase, receipt, management or use of tickets.
1.4. Ticket Vendor
The organisation, association, foundation, sports club, business club, company, institution or other party that offers or sells tickets for an event via 4planning.
1.5. Platform
The digital environment of 4planning, including the app, web application, public ticket shop, payment environment, ticket page, email confirmation, QR code, and other components with which tickets can be purchased, received, or used.
1.6. Ticket
A digital or physical access ticket, with or without a QR code, for an event organised by or on behalf of the ticket seller and offered via 4planning.
1.7. Ticket Buyer
The natural person or legal entity who purchases, books, receives, or uses a ticket via 4planning for an event of the ticket seller.
1.8. Event
Any activity, gathering, match, meeting, training session, performance, party, business meeting or other event for which tickets are offered via 4planning.
1.9. Agreement
The agreement that comes into being when purchasing, reserving, or obtaining a ticket via 4planning.
1.10. Service Charges
Costs that may be charged for using the ticket module, technical processing, administration, or other services associated with ticket sales.
1.11. Booking fees
Costs associated with processing, administering or fulfilling a ticket order.
1.12. Transaction costs
Costs associated with using a particular payment method or payment provider.
Article 2 – Applicability
2.1. These general ticket conditions apply to every purchase, reservation, acquisition, and use of tickets via 4planning.
2.2. By purchasing, booking, receiving or using a ticket via 4planning, you declare that you agree to these terms and conditions.
2.3. These terms and conditions apply in addition to any supplementary terms and conditions from the ticket seller, such as house rules, visitor conditions, cancellation terms or event terms.
2.4. In case of contradiction between these terms and the terms of the ticket vendor, these terms shall apply with regard to the use of 4planning, the technical processing of tickets, payment via the platform and the delivery of the ticket.
2.5. If one or more provisions of these terms and conditions are found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
2.6. 4planning may change these terms. Amended terms will be announced via the website, by email, or via the platform.
Article 3 – Role of 4planning and role of the ticket seller
4planning makes the platform technically available, enabling ticket sellers to offer tickets and ticket buyers to purchase, receive, and use tickets.
4planning is not an organiser, co-organiser, producer or content provider of the event.
3.3. The ticket seller is responsible for the event, the content of the offer, the ticket information, the execution, the access, the security, any changes, cancellations, and communication with ticket buyers.
3.4. When you purchase or reserve a ticket via 4planning, the agreement for the ticket is established between you and the ticket seller, unless explicitly stated otherwise.
3.5. 4planning is not a party to the agreement between you and the ticket seller regarding the event itself.
3.6. 4planning is not liable for the continuation, modification, relocation, cancellation, performance or attendance of the event.
Article 4 – Ticket Purchase
4.1. You can purchase or reserve tickets for events from ticket sellers via the platform.
4.2. During the purchase process, the available ticket types, prices, any costs, payment methods, and relevant information will be displayed.
4.3. You are responsible for checking the selected tickets, date, time, number of tickets, price, personal details, email address and any other information before completing your order.
4.4. 4planning is not liable for errors arising from you entering incorrect or incomplete data.
4.5. Upon successful payment or booking, you will receive the ticket or a link to the ticket via email or another method supported by the platform.
4.6. The ticket vendor may impose conditions on the purchase or use of tickets, such as a maximum number of tickets per person, age limits, entry requirements, or ticket personalisation.
4.7. 4planning may refuse, cancel, block or further examine an order if there is suspicion of abuse, fraud, technical errors, unlawful sale, payment problems or breach of these terms and conditions.
Article 5 – Prices, costs, and payment
5.1. The selling price of the ticket is determined by the ticket seller and is displayed during the purchase process.
5.2. In addition to the ticket price, service fees, booking fees, transaction fees, or other charges may apply.
5.3. Any additional costs will be displayed where possible before completing the purchase.
5.4. Payment shall be made via the payment methods offered on the platform.
5.5. If any additional charges apply to a specific payment method, these will be indicated during the purchasing process wherever possible.
4planning is not liable for, or responsible for, price changes, typographical errors, obvious mistakes or incorrect prices entered by the ticket seller.
5.7. In the event of an apparent error in the price or the offer, 4planning or the ticket seller may correct or cancel the order, insofar as this is legally permissible.
5.8. A ticket will only be delivered once payment has been successfully processed, unless it is a free ticket or another form of reservation permitted by the ticket seller.
Article 6 – Delivery of Tickets
6.1. Tickets will be delivered digitally via email, a download link, a QR code, the app, or any other method supported by 4planning.
6.2. You are responsible for providing a correct and reachable email address.
6.3. If you do not receive a ticket, you should first check your spam folder, junk mail, or the email address you entered.
6.4. If the ticket cannot be delivered due to an incorrect email address, full mailbox, technical blockage or other circumstande on your part, 4planning is not liable for this.
6.5. You are solely responsible for keeping your ticket safe and for presenting it upon entry to the event.
6.6. 4planning is not obliged to re-issue a ticket if you have lost, deleted, or are otherwise unable to access it, but may endeavour to make the ticket available again if technically feasible.
Article 7 – Use of Tickets
7.1. A ticket solely grants admission to the event for which the ticket has been issued, under the ticket seller's terms and conditions.
7.2. A ticket may only be used once, unless otherwise explicitly stated.
7.3. If a ticket is provided with a QR code or other unique code, this code will be checked upon entry.
7.4. You are responsible for preventing your ticket or QR code from being copied, shared, or used by unauthorised individuals.
7.5. If a ticket has already been scanned, is invalid, damaged, illegible or does not meet the access requirements, access may be refused.
7.6. The ticket seller is responsible for the final access control and may refuse entry if the access conditions are not met.
7.7. 4planning is not liable for denied access, waiting times, operational issues at the entrance, or decisions made by the ticket vendor or on-site security.
Article 8 – Personalisation and visitor data
8.1. The ticket vendor may request certain personal details to be provided when purchasing a ticket, such as name, email address, place of residence, date of birth, or other details.
8.2. When purchasing multiple tickets, the ticket seller may request that each ticket be personalised with the details of the respective visitor.
8.3. You are responsible for the accuracy, completeness, and lawfulness of all data you enter, even when this data relates to other visitors.
8.4. If you enter data of other visitors, you declare that you are authorised to provide this data.
8.5. Incorrect or incomplete details may affect the delivery, validity, or access to the ticket.
Article 9 – Right of withdrawal and cancellation by ticket purchaser
9.1. In principle, there is no statutory right of withdrawal for tickets for events, activities or services on a specific date or within a specific period.
By purchasing a ticket via 4planning, you agree that the ticket will be made available digitally immediately and that the purchase is final, unless the ticket seller expressly offers different cancellation terms.
9.3. You cannot cancel, return or exchange a ticket free of charge on the grounds of the normal right of withdrawal for online purchases, to the extent that the legal exception applies.
9.4. If the ticket vendor applies their own cancellation, modification, or exchange conditions, these conditions shall apply between you and the ticket vendor.
9.5. Requests for cancellation, modification, refund or exchange must be addressed to the ticket vendor, unless the platform offers a different procedure for this.
Article 10 – Cancellation, amendment or postponement of the event
10.1. The ticket seller is responsible for the cancellation, alteration, or postponement of an event.
10.2. If an event is cancelled, changed or postponed, the ticket seller must inform you about this.
4planning is not responsible for the cancellation, modification, or relocation of an event.
10.4. Any rights to refunds, replacement tickets, credit, or other compensation must be exercised by you towards the ticket seller.
10.5. If 4planning processes refunds on behalf of or at the request of the ticket seller, this will be done solely on the instruction of the ticket seller or if legally required.
10.6. In the event of a cancellation, statutory rules may apply regarding the refund of ticket prices and fees. The ticket seller remains responsible for compliance therewith.
Article 11 – Refunds and reimbursements
11.1. A refund will only be issued if the ticket vendor decides to do so, if it is stipulated in the ticket vendor's terms and conditions, or if it is legally required.
11.2. 4planning generally does not issue refunds without the instruction or agreement of the ticket seller.
11.3. If a refund is processed, it will be done via the original payment method or via another available method, where technically feasible.
11.4. The timeframe within which a refund is visible in your account may vary depending on banks, payment providers, and payment methods used.
11.5. Service fees, booking fees, and transaction fees will only be refunded if legally required, decided by the ticket vendor, or explicitly stated.
4planning is not liable for delays, refusals, or blockages by banks, payment providers, or other financial service providers.
Article 12 – Prohibited Use and Misuse
12.1. You may not use the platform and tickets for fraud, deception, money laundering, unauthorised resale, spam, technical manipulation or other unlawful purposes.
12.2. You may not attempt to bypass, disrupt or test the security, QR codes, payment environment, ticket inspection or functionality of the platform without prior written permission from 4planning.
12.3. You may not enter false information or impersonate another person or organisation.
12.4. You may not use the platform in a manner that impedes access to or use by other ticket buyers, ticket sellers, or users.
12.5. In case of misuse, fraud, breach of these terms, or a reasonable suspicion thereof, 4planning may block the purchase, invalidate tickets, restrict access to the platform, or take other appropriate measures.
Article 13 – Platform Availability
13.1. 4planning will endeavour to make the platform available carefully and to the best of its ability.
13.2. 4planning does not guarantee that the platform will always be available without interruption, errors, or failures.
4.3. 4planning may temporarily take the platform out of service or restrict its use for maintenance, updates, security measures, technical changes or improvements.
13.4. 4plan reserves the right to change, expand, restrict or remove functionalities of the platform.
13.5. 4planning shall not be liable for damage caused by temporary unavailability, malfunctions, delays, maintenance, technical errors or problems with third parties, unless such damage is caused by intent or deliberate recklessness on the part of 4planning.
Article 14 – Personal Data and Privacy
14.1. When purchasing, reserving, receiving, or using tickets via 4planning, personal data may be processed.
14.2. The ticket vendor is in principle responsible for the personal data processed in the context of the event and ticket sales.
14.3. 4planning processes personal data to the extent necessary for the provision of the platform, the ticket module, payment processing, ticket communication, security, fraud prevention, and compliance with legal obligations.
14.4. The ticket seller may request additional personal data. The ticket seller is responsible for the necessity and lawfulness thereof.

14.6. For questions regarding personal data connected to the event, your participation, or visitor data, you can initially contact the ticket seller.

Article 15 – Intellectual Property
15.1. All intellectual property rights on 4planning, the platform, the software, design, technical solutions, texts, logos, documentation, and other materials remain the property of 4planning or its licensors.
15.2. You are granted a limited, personal, non-exclusive, non-transferable, and revocable right to use the platform solely for purchasing, receiving, or using tickets.
15.3. It is not permitted to copy, modify, distribute, sell, rent, reverse engineer or otherwise use the platform, the ticket module or parts thereof outside of their normal use.
15.4. 4planning may take technical measures to secure the platform, tickets, QR codes, and payment processes.
15.5. You may not remove, bypass, circumvent or allow to be circumvented these technical measures.
Article 16 – Liability
16.1. 4planning is solely responsible for making the platform and the ticket module available to the best of its ability.
16.2. 4planning is not liable for damages relating to the event, its execution, access, security, cancellation, alteration, postponement, communication or actions of the ticket seller.
16.3. 4planning is not liable for damage caused by incorrect or incomplete data that you enter, including an incorrect email address or inaccurate visitor details.
16.4. 4planning is not liable for damages caused by misuse, loss, copying or unauthorised sharing of your ticket or QR code.
16.5. 4planning is not liable for indirect damage, consequential loss, loss of data, missed savings, reputational damage, business stagnation, or damage caused by third parties.
16.6. If 4planning is liable despite these terms, the total liability will be limited to a maximum of the amount you paid to 4planning or via the platform for the relevant ticket, with a maximum of €500.
16.7. The limitations of liability do not apply in the event of wilful misconduct or gross negligence on the part of 4planning.
Article 17 – Disclaimer
17.1. You shall indemnify 4planning against third-party claims arising from your unlawful use of the platform, your breach of these terms, incorrect data provided by you, or misuse of tickets.
17.2. This exclusion of liability does not apply if the claim results from wilful misconduct or gross negligence on the part of 4planning.
Article 18 – Duration and termination
18.1. The agreement concerning the use of the platform for the purchase of a ticket is concluded at the moment of purchase, reservation, or acquisition of the ticket.
18.2. 4planning may restrict, block or terminate your access to the platform or your ticket if you breach these terms and conditions or if it is necessary for safety, fraud prevention, payment processing or the protection of third parties.
18.3. If you have already made use of the services or the ticket has already been delivered, any services already provided and payment obligations shall not be reversed, unless otherwise required by law.
18.4. Following termination or blocking, 4planning may restrict, delete or make inaccessible access to stored tickets or data, to the extent permitted by law.
Article 19 – Force Majeure
19.1. 4planning is not obliged to fulfil its obligations if it is prevented from doing so by force majeure.
19.2. Force majeure includes, but is not limited to: internet failures, hosting problems, power outages, cyber-attacks, DDoS attacks, failures with payment providers, failures with third parties, government measures, war, fire, natural disasters, labour disputes and other circumstances beyond the reasonable control of 4planning.
19.3. Malfunctions, delays or restrictions with payment providers, banks or financial institutions shall also apply as force majeure for 4planning.
Article 20 – Applicable law and disputes
20.1. These terms and the use of the platform are exclusively governed by Dutch law.
20.2. The parties shall endeavour to resolve disputes amicably through mutual consultation first.
20.3. If a dispute cannot be resolved through consultation, the dispute shall be submitted to the competent court in the Netherlands, unless mandatory law dictates otherwise.
Article 21 – Contact
21.1. For queries regarding the event, access, cancellation, amendment, refunds, or ticket conditions, please contact the ticket vendor.
21.2. For questions regarding the use of 4planning or these terms and conditions, please contact us via info@4planning.nl.
Article 22 – Final Provisions
22.1. If one or more provisions of these terms and conditions are found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
22.2. In situations not covered by these terms and conditions, 4planning shall act in accordance with reasonableness, fairness, and usual trade practices.
22.3. These terms and conditions, together with the ticket information shown, any terms and conditions of the ticket vendor, and the purchase confirmation, constitute the terms and conditions under which you purchase, receive, or use a ticket via 4planning.
